General Terms & Conditions

1. All deliveries and services of the company Med.SSE-System GmbH Alfred von der Lehr, Fürth by online orders over the Internet or other online services are subject to these general terms and conditions. Deviating and/or supplementary agreements require the explicit approval of Med.SSESystem GmbH Alfred von der Lehr, Fürth in writing; this also in valid for a waiver of the requirement of written form.

2. Med.SSE-System GmbH Alfred von der Lehr, Fürth will adhere to agreed or stated delivery times in a timely manner as possible. If these are exceeded by more than six weeks, the customer has the right to set an extension of time with the notice that he will deny acceptance of the purchase item after expiration of the term. This extension of time must be at least one month long. If an agreement for a new delivery date is not possible, the customer may resign from the contract after expiration of the extension of time by written declaration. If the customer should demand damage compensation in case of delay or impossibility because of non-fulfilment, it is limited to at the most 5% of the purchase price upon minor negligence and only includes the compensation of the direct damage, meaning specifically not the compensation of the lost profit of other indirect damage. Further claims of the customer - especially on delivery - are excluded.

3. The risk is transferred to the customer as soon as the goods have been given to the transport company and have left the warehouse. This is also valid if Med.SSE-System GmbH Alfred von der Lehr, Fürth has taken over the transport costs. Reclamations due to transport damages must be declared by the customer directly to the transport company within the intended terms. In case of shipments of the customer to Med.SSE-System GmbH Alfred von der Lehr, Fürth the customer carries all risks, especially the risk of transport, up to the delivery of the goods to Med.SSE-System GmbH Alfred von der Lehr, Fürth.

4. Reclamations due to scope of delivery, defects, wrong deliveries and false quantities are, insofar these can be determined with reasonable examinations to be declared immediately, at the latest however within one week after receipt of the goods in writing. The term of warranty by Med.SSE-System GmbH Alfred von der Lehr, Fürth is six months from receipt of the goods. In case of rightful reclamations Med.SSE-System GmbH Alfred von der Lehr, Fürth will supplementarily deliver false quantities, and in all other cases exchange the goods under reservation of exclusion by your choice, take the goods back, or grant the customer a reduction in price. If the second supplementary delivery in case of exchange is also faulty, the customer has the right commutation or reduction. The warranty for faults in devices is limited to supplementary performance.

5. The object of purchase remains property of Med.SEE-System GmbH Alfred von der Lehr, Fürth until the balance of the claims Med.SEE-System GmbH Alfred von der Lehr, Fürth is entitled to is given due to the contract. Insofar computer programmes belong to the scope of delivery, the customer is generally granted an unlimited right for loading and running the programme, as well as for the creation of a safety copy, insofar no deviating statements are included in the licence conditions of the corresponding programme. The customer is obligated to give Med.SSE-System GmbH Alfred von der Lehr, Fürth all information necessary in the framework of a pursuance of rights from the agreed retention of title.

6. Med.SSE-System GmbH Alfred von der Lehr, Fürth is authorized to collect the personal data of the customer required in the framework of the business relationship, to save them and process them.

7. The invalidity of individual items of these general terms and conditions does not have effect on the validity of the remaining conditions. A new condition shall replace the invalid condition, which shall be as similar to the invalid condition in business effect as possible. Place of fulfilment and place of jurisdiction for contracts that were concluded under inclusion of these general terms and conditions is Nuremberg.
